Every administrative system has a fast lane. Who is in it reveals what the system actually values, beneath the formal equality of its stated procedures.
The Fast Lane in Every System
Every administrative system of sufficient complexity develops informal or formal fast lanes — channels through which some applicants move faster than others, through which some cases receive more careful attention, and through which some people encounter a different quality of service than the standard process provides. These fast lanes exist because administrative systems face resource constraints that prevent delivering high-quality service uniformly, and because the actors who control access to faster or better service have incentives to allocate that access according to criteria that reflect their interests and relationships rather than purely the formal criteria of the process.
The premium service is available through several mechanisms. Professional intermediaries — lawyers, consultants, lobbyists — who have established relationships with agency personnel and who understand the informal channels through which complex cases can be moved more efficiently, provide a purchased form of fast lane access. Political relationships — the case that comes with a legislator's letter of support, the application that comes from a constituent of a powerful committee member — provide a political form. And institutional relationships — the large employer whose employee applications receive different handling than an individual applicant's, the university whose student visa applications are pre-verified rather than individually assessed — provide a volume-based form.
What Fast Lane Access Reveals
The criteria that determine fast lane access reveal the formal system's actual priorities in the same way that any behaviour-based evidence reveals preferences that stated criteria obscure. The formal immigration system applies the same procedures to all applicants. The actual immigration system applies substantially faster procedures to applicants with professional representation, political connections, and institutional backing — which is a statement about what the system actually values, beneath the formal equality of its stated criteria.
This is not primarily a corruption problem, though corruption can be a component. It is a structural problem — the systematic conversion of social, political, and economic capital into administrative access, through mechanisms that are largely within the rules of the formal system even when they violate its spirit. The fast lane is not a hole in the system. It is the system expressing its actual hierarchy of value.
The fast lane tells you what the system is actually for. The stated procedure tells you what it is nominally for. The gap between them is the measure of how much of what the system distributes is determined by formal criteria and how much by the social, political, and economic capital that its informal channels convert into administrative advantage.
